A nondisparagement clause says people can’t talk trash about your biz…but is it actually enforceable?

🤷‍♀️ Sometimes. It depends on the type of agreement it's in, what the consideration is, and how it’s written.

😬 The Consumer Review Fairness Act says you can’t prohibit negative reviews in your standard contract.

⚖️ But defamation (aka FALSE statements that harm you or your business) is always against the law — contract or no contract.

TL;DR: You can’t always stop a bad review when it's honest, but you CAN make sure people aren't spreading misinformation.
