M is for Mediation

In this Instagram reel, I talk about mediation.

Mediation is one of those Alternative Dispute Resolution procedures that I talked about in the video for the letter A. (Feel free to pop back over there for a refresher.)

The idea is that if there is ever a dispute under your contract, the parties can agree to go to mediation to try and resolve things BEFORE seeing each other in a courtroom.

Why do I like mediation?

💥 It’s non-binding (unlike arbitration where you risk being bound to an unfavorable outcome)

💥 It’s collaborative (the parties should agree to use good faith efforts to resolve things)

💥 It takes the temperature down before things explode (no one should be bullied into giving money back because they're afraid of litigation)

I recommend mediation clauses in contracts because they give everyone a chance to resolve a conflict before going straight to court.
